Gray v. Moore, 06-3547
Denial of a petition for a writ of habeas corpus from a conviction for aggravated murder and kidnapping is affirmed in part, and reversed in part where: 1) an Ohio appellate court unreasonably applied Illinois v. Allen, 397 U.S. 337 (1970), and the error had a substantial and injurious effect on the outcome of petitioner's kidnapping conviction; but 2) the record supported the aggravated murder conviction irrespective of the constitutional error.
