Arendale v. City of Memphis, 07-5230

In a civil rights suit brought by a white police officer against the city of Memphis, summary judgment for the city is affirmed where: 1) the implied cause of action contained in 42 U.S.C. section 1981 does not provide for municipal liability; 2) summary judgment was proper on a section 1983 disparate treatment claim; 3) for purposes of a hostile environment claim, no reasonable jury could find that plaintiff was harassed because of his race; and 4) there was no competent evidence of retaliation.
