In an action against FedEx alleging, inter alia, that plaintiff was discriminated against based on his race in violation of civil rights laws, dismissal of plaintiff's case pursuant to Fed. R. Civ. P. 50 is reversed where the district court applied an overly narrow construction of the "similarly situated" standard.
