Ziegler v. Aukerman, 06-2618
In a civil rights action filed under 42 U.S.C. section 1983, summary judgment for defendant-police officer is affirmed where, although the district court applied an incorrect legal standard in determining defendant's summary judgment motion, applying the proper legal standard to the district court's findings of fact would not alter the outcome of the district court's decision.
