Commodity Futures Trading Comm'n v. Erskine, 06-3896

In a suit brought by the Commodities Futures Trading Commission (CFTC) against defendant and his company alleging he misrepresented facts and omitted pertinent information when soliciting customers to trade in foreign currency, in violation of the Commodity Exchange Act (CEA), summary judgment for defendant is affirmed where the trades at issue were not "futures contracts" subject to the CFTC's jurisdiction.
