Truck Drivers Local No. 164 v. Allied Waste Sys., Inc., 06-1572

In proceedings arising when a driver was terminated for backing his truck into low-hanging telephone lines, summary judgment for employer vacating an arbitrator's award ordering reinstatement of the employee is reversed where the arbitrator was faithfully attempting to construe and apply the terms of the collective bargaining agreement, the arbitrator was acting within the scope of his authority, and the district court lacked legal authority upon which to vacate the award.
