Gruener v. The Ohio Cas. Ins. Co., 05-4220
In an action brought under the Americans with Disabilities Act (ADA), a jury verdict for plaintiff's former employer pursuant to a finding that she failed to prove she was disabled is affirmed where: 1) plaintiff failed to present evidence warranting a regarded-as-disabled instruction; and 2) she failed to amend her notice of appeal to include the trial court's order denying her motion for a new trial.
