Beattie v. CenturyTel, Inc., 06-1565
In a class action alleging that defendant-telecommunications service provider violated federal and state law by using deceptive billing practices to bill customers for a wire maintenance program, a decision certifying the class is affirmed as to certification of the class on its federal-law claims under Rule 23 of the Federal Rules of Civil Procedure, but remanded as to the state law claims for purposes of a Rule 23 analysis.
