In re: S. Air Transp., Inc., 06-3796
In a bankruptcy trustee's action seeking to recover a $100,000 payment made to defendant as an avoidable preference under the Bankruptcy Code, a ruling in favor of the trustee is reversed where the trustee in bankruptcy failed to meet his burden of proving the elements necessary to establish that the payment to defendant was preferential, and thus avoidable under 11 U.S.C. section 547(b).
