Popovich v. Sony Music Entm't, Inc., 06-3463/3464
A judgment pursuant to a jury verdict awarding plaintiff five million dollars on his claim that Sony Music Entertainment breached its duty to affix his record company logo to four Meat Loaf albums is affirmed in part, but reversed in part and remanded where: 1) there was no error in the verdict, summary judgment and JMOL rulings, the district court's denial of pre-judgment interest, or its exclusion of internet downloads from Sony's logo obligations; but 2) a decision, which restricted discovery related to any new obligations created by a 1998 Agreement to the eight countries delineated in the original 1977 agreement, was error.
