Ilic-Lee v. Mukasey, 06-3494, 06-4089
Serbian citizen's petition for review of BIA decisions affirming an IJ's denial of petitioner's motion for continuance, vacating the IJ's denial of petitioner's motion to reopen, and denying petitioner's direct motion to reopen, is denied where: 1) there was no abuse of discretion in affirming the denial of the motion for a continuance or in the finding regarding the motion to reopen; and 2) although petitioner provided some evidence of a legal marriage, it was insufficient to establish that the marriage was bona fide and was not strong enough to show that the BIA abused its discretion.
