US v. Conces, 07-1343
In an action brought by the government seeking to enjoin defendant from promoting an alleged tax-fraud scheme and engaging in other conduct allegedly interfering with the administration and enforcement of the federal tax laws, an order finding defendant in civil contempt due to discovery non-compliance and directing that he be incarcerated until he complies with prior orders is affirmed where: 1) certain of defendant's challenges were not properly before the circuit court; 2) defendant's constitutional rights were not violated by an order requiring him to respond to the government's post-judgment discovery requests; 3) the district court complied with procedural rules in making the orders below; 4) it had no obligation to produce any "Oaths of Office"; and 5) defendant was properly found in contempt and incarcerated.
