United States Sixth Circuit

In an action under 42 U.S.C. section 1983 arising in large part from some plaintiffs' arrests and prosecution for open burning without a permit after they burned a rainbow flag at a Gay Pride parade, dismissal of the claims is affirmed for the most part, but reversed in part and remanded where the district court erred by holding that plaintiffs lacked standing to pursue their claims for injunctive relief.
