Grant of habeas relief as to the death sentence imposed for a conviction for kidnapping and aggravated murder is affirmed on the ground that his trial attorney had rendered ineffective assistance of counsel at the penalty phase of the trial by failing to adequately investigate and present mitigating evidence, and such error was prejudicial. The denial of habeas relief as to the conviction is affirmed on cross-appeal over claims challenging rulings that: 1) counsel was not ineffective at the guilt phase of the trial; and 2) the trial court did not err in striking a juror that it found was not death-qualified and lacked an adequate understanding of the proceedings.
