Thomas v. Speedway SuperAmerica, LLC, 06-3768

In a case involving store manager's claims for unpaid overtime wages under both federal and state law, summary judgment for defendant denying the claims is affirmed where defendant satisfied its burden of showing that plaintiff's primary duty consisted of management, for purposes of being a bona fide executive employee under 29 U.S.C. section 213(a)(1) and not being entitled to overtime wages.
