Sierra Club v. Hamilton County Bd. of County Comm'rs, 05-4437
In a Clean Water Act case, an award of attorney's fees to the Sierra Club and individual plaintiff, and against defendant-county, is affirmed in part but remanded where: 1) the district court did not err in determining that the Sierra Club was entitled to recover attorney's fees as a "prevailing or substantially prevailing party" in the case; 2) a remand was required for a particularized determination of the amount of the award.
