Spencer v. ADT Sec. Servs., Inc., 06-2537
In an action claiming that defendant-ADT is responsible for plaintiff's mother's death by failing to dispatch an ambulance to her address after she pressed an ADT-issued emergency call button, dismissal of the tort claim on summary judgment is affirmed as the district court correctly held that this case sounds in contract and not in tort.
