Midwest Media Prop., L.L.C. v. Symmes Township, Ohio, 06-3828
In an action claiming that a township's sign regulations violated the First and Fourteenth Amendment, summary judgment for the township is affirmed as, because certain valid size and height requirements were severable from the allegedly unconstitutional provisions at issue, and because they prohibited plaintiffs from obtaining relief on their damages and injunction claims, the district court properly relied on those provisions in concluding that plaintiffs lacked standing to bring the lawsuit.
