US v. Ross, 05-4469

Conviction for bank fraud is affirmed where: 1) the district court did not abuse its discretion in giving a deliberate ignorance instruction; 2) nor was there an abuse of discretion in overruling an objection to the government's cross-examination regarding defendant's personal bankruptcy petition; and 3) the evidence was sufficient to support the convictions. However, the sentence is vacated as the district court's determination of intended loss at sentencing was in error.
