United States Sixth Circuit

Operation King's Dream v. Connerly, 06-2144, 06-2258

In a suit brought seeking to enjoin the placement on the ballot of a citizen-initiated proposal that would amend Michigan's constitution to prohibit all sex- and race-based preferences in public education, employment, and contracting, an appeal from a denial of a preliminary injunction and dismissal of plaintiffs' Voting Rights Act claim is dismissed as moot as the opportunity to keep the proposal off the ballot has long since passed.
