O'Neill v. Kemper Ins. Cos., 06-4416
In a suit over the obligation of an insurer to pay attorney's fees after an action against plaintiff for judicial misconduct, summary judgment for defendants-insurers is affirmed where: 1) the district court correctly interpreted the policy as limiting payment of attorney's fees to actions that resulted in a finding of no fault; and 2) since there was a valid, enforceable contract, plaintiff cannot mount a claim for promissory estoppel that directly contradicts the language of that contract.
