Thomas v. Miller, 05-2404
In an action brought against plaintiff's former employer and supervisor for health benefits under the Consolidated Omnibus Reconciliation Act (COBRA), summary judgment for defendants is affirmed where: 1) although the doctrine of equitable estoppel can bar an employer, concededly not meeting COBRA's numerical application threshold, from defending an action under that statute on that basis; nevertheless 2) plaintiff could not satisfy the estoppel doctrine's requirements in this case.
