Thompson v. Aramark Sch. Support Servs., Inc., 05-2676
In an action brought by a former food service worker against her employer alleging that she was terminated in violation of the Michigan Whistleblowers' Protection Act (WPA) for reporting the existence of unsanitary conditions in food storage and preparation areas to a school board, summary judgment for defendant is vacated and remanded where there was sufficient evidence to permit a reasonable jury to find a prima facie case of violation of the WPA; and 2) the question of whether defendant acted on the basis of a legitimate, non-retaliatory reason in the discharge is a disputed question of fact precluding summary judgment.
