United States Sixth Circuit
Garza-Moreno v. Gonzales, 06-3562, 06-4024
8 U.S.C. section 1252 does not strip the court of appeals of jurisdiction to review the denial of an administrative closure. A petition for review of a BIA order to have petitioners removed is dismissed in part and denied in part over claims that: 1) they were denied due process by various problems with the proceedings before the IJ and the BIA; 2) the BIA erred in denying cancellation of removal; and 3) the BIA abused its discretion by refusing to administratively close the case.
