Jaber v. Gonzales, 05-3882

A petition for review of a decision by the BIA denying petitioner's motion to reopen a prior removal decision is dismissed for lack of jurisdiction where: 1) petitioner had not filed a petition for review of the BIA's determination on whether to reopen; and 2) the district court did not transfer petitioner's challenge to the BIA's final determination on whether to reopen, but only transferred a challenge to the initial removal decision.
