United States Sixth Circuit
J.B.D.L. Corp. v. Wyeth-Ayerst Labs., Inc., 05-3860, 05-3988
In a suit brought against defendant under section 2 of the Sherman Act arising from defendant's efforts to protect its market share in the oral estrogen replacement therapy market through the use of contractual agreements with third-party payer entities, summary judgment for defendant is affirmed where the evidence in the record did not create a genuine issue of material fact as to the causal relationship between a "Premarin Preemptive Plan" and an increase in the price of Premarin.
