United States Sixth Circuit
Nat'l Labor Relations Bd. v. Local 334, 05-1579, 05-1639, 05-1714
An order of the NLRB directing a union and employer to cease and desist unfair labor practices and interference with certain union members' rights under the National Labor Relations Act (NLRA) is enforced where: 1) a finding that union and employer did not have an exclusive hiring hall arrangement was supported by substantial evidence; and 2) consequently, the union and employer violated the NLRA as the union was not entitled to compel employer to hire only its referrals, and the employer was not justified in acquiescing to the union's hiring demands.
