United States Sixth Circuit
US v. Davist, 06-1224
A sentence for false claims against the U.S., conspiracy to defraud the U.S., and false statements is affirmed over a claim that the district court erred in issuing a two-point enhancement for obstruction of justice under U.S.S.G. section 3C1.1. Where a defendant is convicted of a separate count for obstructive conduct, the two-point enhancement under section 3C1.1 applies.
