In an action against the Attorney General and the Director of the FBI alleging that plaintiff was denied reinstatement as an FBI Special Agent as a result of unlawful retaliation by a former supervisor, about whose racially discriminatory conduct plaintiff had previously complained, summary judgment for defendants is affirmed where, although plaintiff was entitled to equitable tolling with regard to a delay in seeking EEO counseling, he nonetheless failed to show that there were any genuine issues of material fact regarding the causation element of his prima facie case.
