Petty v. County of Franklin, Ohio, 06-3552
In a 42 U.S.C. section 1983 case brought by former inmate who sustained serious injury to his jaw during a fight with other inmates, alleging county defendants failed to protect him and provide adequate medical care, dismissal of plaintiff's claims is affirmed where: 1) two John Doe deputies were properly dismissed from the suit as they had not been served within the requisite time and plaintiff had ample time to discover their identities; and 2) summary judgment for defendants county, sheriff's office, and sheriff was proper as well.
