Nat'l Parks Conservation Ass'n, Inc. v. Tennessee Valley Auth., 05-6329
In a suit brought by environmental organizations under the Clean Air Act alleging that the Tennessee Valley Authority (TVA) shirked its duty to obtain appropriate pollution limitations at a power plant it operates, summary judgment for the TVA is reversed where plaintiffs' claims for civil penalties were timely insofar as they related to violations that occurred within five years of the date they filed their initial complaint.
