Union Planters Bank, N.A. v. Continental Cas. Co., 05-6094, 05-6095

In a dispute over insurance coverage arising when plaintiff-bank suffered a multi-million-dollar loss stemming from a mortgage lender's fraud, summary judgment against a primary carrier and in favor of excess carriers is affirmed where: 1) the district court correctly determined that bank was entitled to coverage under its primary policy; and 2) bank failed to satisfy a provision in each of the excess carriers' supplemental insurance policies which required "simultaneous notice" of any claim made under the primary coverage policy.
