US v. Barnwell, 04-2143

Convictions for embezzlement and theft of labor union assets and conspiracy to engage in misappropriation of union assets are reversed where five ex parte meetings and communications between the trial judge, prosecution, and government agents violated defendant's constitutionally prescribed rights to due process, effective assistance of counsel, and trial by an impartial judge and jury.
