In a 42 U.S.C. section 1983 civil rights action stemming from an individual's death during his arrest by defendants-police officers, summary judgment for defendant-officer is reversed where there were material disputes of fact concerning the reasonableness of his action in subduing the decedent, specifically, in using a choke hold.
