US v. Mooneyham, 04-5189, 04-5190

Defendant's convictions on drug related charges are affirmed over claims of error regarding: 1) denial of motions for continuance and for substitution of counsel; 2) a failure to disclose a sealed plea agreement; and 3) permitting the prosecution to play a tape-recording for the jury that contained a hearsay statement. The matter is remanded for resentencing pursuant to Booker.
