United States Sixth Circuit
Fieger v. Ferry, 05-1295
Dismissal of a 42 U.S.C. section 1983 civil rights action challenging the refusal of certain Michigan Supreme Court Justices to recuse themselves from cases in which plaintiff-former gubernatorial candidate is involved is affirmed in part as to dismissal of a challenge to past recusal decisions, but reversed in part as to dismissal of a challenge to the constitutionality of Michigan's recusal rule as the Rooker-Feldman doctrine did not bar the claim.
