Mike's Train House v. Lionel, L.L.C., 05-1095

In a dispute between model train distributors, denial of motions for a new trial and grant of an injunction pursuant to a jury verdict and award for plaintiff on claims of misappropriation of trade secrets and unjust enrichment are reversed where: 1) the district court erred in admitting expert testimony and in imposing joint-and-several liability, and the jury award improperly "double count[ed]" plaintiff's damages; and 2) the injunction was based entirely on the jury's verdict.
