United States Sixth Circuit

Lyell v. Renico, 04-1106

Denial of a petition for a writ of habeas corpus from a conviction for assault with intent to commit murder, which claimed that a trial court coerced the jury into reaching a guilty verdict by improperly polling the jury and exhibited bias and partiality that denied petitioner a fair trial, is reversed in part where the trial judge's conduct violated petitioner's due-process right to a fair trial.
