Club Italia Soccer & Sports Org. v. Charter Township of Shelby, Michigan, 05-2360
In a 42 U.S.C. section 1983 action arising from defendant-township's acceptance of a soccer complex development proposal without first granting plaintiff, a non-profit sports organization, the opportunity to submit a bid on terms equal to the winning bidder, summary judgment for defendant is affirmed where, although plaintiff had standing for its claims, it failed to state a claim based upon either due process or equal protection.
