United States Sixth Circuit

In a capital aggravated murder case, grant of a writ of habeas corpus on grounds relating to a fundamental error in the capital specification is affirmed on appeal by the state, and over claims of error attacking the aggravated murder conviction regarding: 1) admission of evidence; 2) a refusal to grant a change of venue; 3) a Brady claim; and 4) prosecutorial misconduct.
