Solomon v. US, 04-3650

Denial of defendant's motion to vacate, set aside, or correct sentence for knowingly and intentionally possessing with the intent to distribute crack cocaine is reversed where, regardless of whether the district court erred in sua sponte raising the AEDPA's statute of limitations to find the motion untimely, petitioner was entitled to equitable tolling.
