Nicholson v. City of Warren, 06-1358

In an action filed pursuant to the Americans with Disabilities Act (ADA) against a city alleging plaintiff was injured when her wheelchair was not properly secured in a transportation van provided by defendant, an order denying plaintiff's motion for an extension of time to appeal from dismissal is affirmed where there was no abuse of discretion in the denial as plaintiff failed to establish good cause or excusable neglect.
