Dando v. Yukins, 04-1691

Denial of a habeas corpus petition from petitioner's conviction for robbery and related charges is reversed where: 1) an ineffective assistance claim was not procedurally defaulted and she had met statutory exhaustion requirements; 2) her trial counsel was ineffective for failing to properly investigate a duress defense based on Battered Woman-s Syndrome; and 3) she was prejudiced by the inadequate representation in deciding to plead guilty.
