Howard v. Bayes, 05-5076

Summary judgment for defendants on plaintiff's civil rights claim under 42 U.S.C. section 1983 and a wrongful death claim under Kentucky state law is affirmed where plaintiff failed to allege a cognizable procedural due process violation, and could not establish a wrongful death claim under state law.
