Almuhtaseb v. Gonzales, 04-3984

Petition for review of BIA denial of applications for asylum and withholding of removal is dismissed as it relates to the asylum claim because the court lacks jurisdiction to review matters of timeliness when only factual or discretionary issues are presented, and denial of withholding is affirmed where the petitioner could not meet the high standards for relief.
