United States Sixth Circuit

Lorillard Tobacco Co. v. Amouri's Grand Foods, Inc., 05-1642

Denial of a cigarette-maker's motion for a preliminary injunction in an action asserting trademark, unfair competition and consumer protection violations under federal and state law is reversed where: 1) the district court failed to apply the appropriate four-factor test; and 2) plaintiff adequately demonstrated that the factors supported the relief sought, so that a grant of the requested injunction was proper.
