United States Sixth Circuit
US v. Brown, 05-5437
Denial of a motion to suppress evidence on drug-related offenses obtained as a result of a warrantless entry into defendant's home by a police officer responding to the reported activation of his home security system is affirmed over claims that the district court erred in finding: 1) that an officer's entry into a basement was justified under the exigent circumstances exception to the warrant requirement; and 2) that an officer's entry into an interior room of the basement did not exceed the scope of the exigency.
