United States Sixth Circuit
Cleveland Elec. Illuminating Co. v. Util. Workers Union of Am., 04-3566, 04-3567
Enforcement of an arbitrator's determination that a grievance filed by defendant-union on behalf of retirees was arbitrable is affirmed where plaintiff-employer waived the issue of who had the power to decide the arbitrability of the grievance, and there was no error in the adoption of the arbitrator's decision on arbitrability.
