Linscott v. Rose, 04-3474

Denial of defendant's petition for a writ of habeas corpus from his sentence for gross sexual imposition is affirmed where defendant's petition for relief was timely, but defendant failed to show that an alleged error in the use of certain evidence had a substantial and injurious effect or influence on his resentencing.
