Sako v. Gonzales, 04-3426

Denial of petitioner's motion to reopen removal proceedings due to ineffective assistance of counsel is affirmed where denial of an opportunity to remain in the country while awaiting the outcome of his appeal did not constitute a denial of due process, and there was no abuse of discretion in the denial.
